Penalties

  • Individuals are responsible for their own actions and can be sued.
  • The court can award up to $150,000 for each separate act of willful infringement (i.e. you knew the use was wrong, but did it anyway). For example, you used 10 copyrighted works, and each use was determined to be an infringement, the penalty could be as much as $1,500,000.
  • Ignorance of the law is not a defense. You are still liable for damages, but the amount of the award will be affected.
  • The Texas Constitution limits UT System's ability to defend you if it is determined you knowingly broke the law.
